01Introduction

These terms apply to this website and to the services provided under the NeelendraBuilds name. NeelendraBuilds is the trading name used by Neelendra Shivhare, an individual freelancer working as a sole proprietor in Banda, Uttar Pradesh, India. It is not a registered company, and using this site or working with us creates no partnership, agency or employment relationship.

By using this website or engaging us for a project, you accept these terms. If you do not accept them, please do not use the site or the services.

These terms are governed by the laws of India, and the courts at Banda, Uttar Pradesh have jurisdiction over any dispute arising from them.

02Services

We provide website design, website development, e-commerce website development, web applications, MVP development and business automation.

The scope of each engagement — what is included, the deliverables, the price and payment schedule, the deadlines, the number of revision rounds, hosting and ongoing maintenance — is agreed separately in writing for that project. These terms do not fix any of those details. Where a written project agreement conflicts with these terms, the project agreement prevails for that project.

We may use subcontractors or third-party components to deliver work, and we remain responsible for that work as agreed.

03Website use

You may use this website for lawful purposes and to find out about our services. You must not:

• use the site for anything unlawful, fraudulent or misleading;

• attempt to gain unauthorised access to the site, its accounts or its infrastructure;

• scrape, harvest or bulk-copy the site's content or contact details;

• upload or transmit malicious code, or interfere with the site's normal operation;

• misrepresent your identity or your connection to another person or business;

• copy the site's content for a competing product or service.

We may change, suspend or withdraw any part of this website at any time.

04Intellectual property

The content of this website — its text, layout, design, graphics, code and case-study material — belongs to NeelendraBuilds unless stated otherwise, and may not be copied, republished or used commercially without written permission.

Ownership of project deliverables is set out in the applicable project agreement. Typically, once the agreed fees are paid, you own the final deliverables created specifically for your project, while we keep ownership of our pre-existing tools, components, libraries and general know-how, and may reuse them in other work. Third-party assets such as fonts, stock images or plugins remain subject to their own licences.

Unless a project agreement says otherwise, we may show completed work in our portfolio and case studies.

Journal articles may be quoted with attribution and a link back to the original page, but may not be republished in full without permission.

05Third-party services

This website and the projects we build depend on third-party platforms: hosting, domain registration, email delivery, messaging, payment processing, and software libraries. Each has its own terms, privacy practices and availability, and we are not responsible for their acts, outages or policy changes. We will help you choose suitable services, and handle migrations where the agreed scope includes them.

06No unsubstantiated guarantees

We do not guarantee search rankings, traffic, revenue, conversion rates or business growth. Search engines, advertising platforms and mobile carriers decide those outcomes using rules we do not control, and results vary by market, competition and business.

We do not guarantee that a website will be available without interruption, or free of every defect. We test our work and fix issues within the agreed support arrangements, but hosting, networks, browsers and third-party services are outside our control.

Figures, examples and case studies published on this site describe past work for specific clients. They are not a promise of the same result for anyone else.

07SMS messaging terms

Program name: NeelendraBuilds SMS Messaging.

Program description: service-related messages about work under way, and — only where permission has been properly obtained — occasional marketing messages about our website development and business automation services.

• Message frequency varies, depending on the programme in use and on your interactions with us.

• Message and data rates may apply. Standard rates charged by your mobile carrier and plan apply to messages you send and receive.

• Reply STOP to stop supported SMS communications.

• Reply HELP where supported, or email hello@neelendrabuilds.com, for assistance.

• Wireless carriers are not liable for delayed or undelivered messages.

• Permission to receive marketing messages is required where the applicable rules demand it. Providing a telephone number for another purpose — an enquiry, a project, an invoice — does not by itself constitute consent to marketing text messages.

• You do not need to make a purchase in order to receive our messages, or to ask us to stop sending them.

How we handle mobile numbers and messaging permissions, including the fact that opt-in data and consent are never shared with third parties or affiliates for their own marketing, is set out in our Privacy Policy.

These terms describe our messaging practices. They are not a consent mechanism, and they do not replace the permission that the applicable rules require.

08Limitation of liability

Nothing in these terms limits or excludes liability that cannot be limited or excluded by law — including liability for death or personal injury caused by negligence, liability for fraud, and any statutory rights you have as a consumer that cannot be waived.

Subject to that: we are not liable for indirect or consequential loss, loss of profit, loss of anticipated savings, loss of data or business interruption; and our total liability for any claim connected with a project is limited to the fees paid to us for that project.

You are responsible for the content, claims and materials you supply for a project, and for keeping your own backups of data, accounts and third-party services where the agreed scope does not include that as a deliverable.

09Changes to these terms

We may update these terms, for example as our services or the applicable rules change. The current version is always published on this page with the last-updated date shown at the top, and a change applies from the date it is published. Terms already agreed in writing for a specific project continue to apply to that project.
